Sec.28(A) applications and that the applications as per Exts.P-1 & P-2 are in relation to Sec.18(1) references, submitted on 19.08.2013. Sri.T.V.George, learned counsel appearing for the petitioners would submit that Exts.P-1 & P-2 applications have been submitted before the 3rd respondent-Land Acquisition Officer on 19.08.2013, which is well within the period of limitation as prescribed in Sec.18(2) of the Land Acquisition Act, etc. Accordingly, the matter will stand remitted to the 3rd respondent-Special Tahsildar (Land AcquisitionI), Kollam, who will immediately trace out all the records in relation to Sec.18(1) reference applications, submitted by the petitioners, as referred to in Ext.P-3. Thereafter, the 3rd respondent will immediately invite the petitioners, for personal hearing and after hearing them, will also make available the photocopies of the relevant records to the petitioners as well. Thereafter, the 2nd respondent will determine as to whether Sec.18(1) reference applications has been filed within time and then will take appropriate decisions thereon. However, it should be made clear that in case, the 3rd respondent is not in a position to trace out all the records, the petitioners cannot be penalised any further and it should be treated as if the petitioners have filed Sec.18 applications as per Exts.P-1 & P-2 within time, unless there are other compelling
