There exists dispute between various factions among the beneficiaries of the Waqf, based on which complaints were received to the Ist respondent. An enquiry was conducted by the Ist respondent Board through one of its Officers. Ext.P2 report of enquiry would indicate that, the officer had recommended for conduct of election to elect the Muthavalli for administration of the Waqf. The report would indicate that, the separate registration granted to the 'Madrassa', with number 9160/RA, is not a correct decision and both the institutions are under the same Waqf, which is already registered with the Ist respondent Board, with number 6047/RA. A group of beneficiaries had filed objections to Ext.P2 report and made request before the Ist respondent to set aside the said report, through Ext.P3 complaint. The petitioner had filed Ext.P5 application before the Waqf Board to cancel the separate registration granted with respect to the 'Madrassa'. While Exts.P3 and P5 petitions are pending before the Waqf Board, the respondents 4 to 7 had filed O.P.No.159 of 2018 before the Waqf Board seeking for appointment of an Advocate Commissioner as Returning Officer for conducting the election of the Waqf registered with number 6047/RA.
