JUDGMENT

This writ petition is filed by the petitioner seeking the

following reliefs:

“1) to issue a writ of mandamus or any other writ or order directing the 1^st respondent herein to fill the 9 seats in the Mount Zion Medical College, Pathanamthitta from the Christian candidates outside the State of Kerala as stipulated in Ext.P3 Government Order.

1. To declare that the 1^st respondent herein is bound to follow Ext.P3 Government Order.

1. To issue a writ of mandamus or any other writ or order directing the 1^st respondent herein to allot a set to the writ petitioner and the grant admission on the basis of Ext.P3 Government Order or in such seats in any other medical colege in the State of Kerala..

1. To issue a writ of mandamus or any other writ or order direting the 1^st respondent herein not to allot the 9 seats allotted to the Christian candidates outside the State of Kerala in Ext.P3 Government Order to any other candidates through counselling or through mope up counselling scheduled to be held on 7^th of August 2019 or on any subsequent dates.

1. To issue a writ of mandamus or any other writ or order directing the 1^st respondent herein to keep on seat vacant out of the 9 seats allotted through Ext.P3 Government Order.

1. To pass any other appropriate writ or order as is deem fit and proper by this Hon'ble Court. “

The sum and substance of the contention put forth by the petitioner is in respect of the seats allotted to outside state christian candidates.

As per an interim order dated 6.8.2019, petitioner was permitted to participate in the mop-up counselling scheduled during the month of August. However, today when the matter is taken up, learned Counsel for the petitioner submitted that, petitioner could not secure an admission.

In that view of the matter, the issues raised by the petitioner in this writ petition has virtually become infructuous. The writ petition is dismissed as infructuous.
