unauthorized encroachers from the puramboke land lying adjacent to the Kaliyar-Kakkadassery PWD road. On the request of the Panchayath authorities, survey of the land was conducted by the Taluk Surveyor, pursuant to which it was found that many people, including the petitioner, had encroached the puramboke land comprised in Survey No. 834/2B/1 of Kadavoor Village. It is further pointed out that eviction proceedings has been initiated against all illegal eviction and that some of them have filed cases in different Courts. The petitioner had also filed case no. 378/10 before the Munsiffs Court, Muvattupuzha, which was dismissed. Thereafter the petitioner filed an appeal which also ended in dismissal. It is further pointed out that the eviction proceedings against the petitioner and the other encroaches would be carried out strictly in accordance with the provisions of the Land Conservancy Act and Rules, which envisages prior notice, except in a case of eviction under Section 13 A of the Land Conservancy Act.
