actual extent of land acquired from the petitioner and also with regard to the compensation/enhanced compensation, etc. in terms of the provisions contained in Sec.64 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation & Resettlement Act, 2013 (Central Act 30 of 2013), which has come into force with effect from 01.01.2014. In this context, the petitioner would point out that though the proceedings were earlier initiated under the old Act (Land Acquisition Act, 1894), in view of the coming into force of the new 2013 Act, with effect from 01.01.2014, the said new Act will regulate the scenario in view of the mandate of Sec.24 of the new Act. The grievance of the petitioner is that till date the respondents, more particularly, the 5th respondent-District Collector has not considered the request made by the petitioner in Ext.P-23 representation in the matter of request for seeking reference under Sec.64 of the said Act to the authority concerned. It is further pointed out that now the competent authority of the State Government has issued statutory notification, notifying that the Court of the Additional District & Sessions Judge-II, Pathanamthitta is the authority to adjudicate reference applications in terms of Sec.64 of the new Act.
