JUDGMENT

The petitioner, who applied for regular stage carriage permit on the route Kunnumpuram-Chemmad as Ordinary Service, which has already been granted vide Ext.P1 proceedings dated 25.09.2018 of the 1^st respondent Secretary of the Regional Transport Authority (vide item No.24), has filed this writ petition under Article 226 of the Constitution of India seeking a writ of mandamus commanding the respondent to settle the timings and issue the regular permit in respect of stage carriage bearing registration No.KL-65/M-7272 to operate on the route Kunnumpuram-Chemmad, within a reasonable time limit to be fixed by this Court.

On 24.05.2019, when this writ petition came up for admission, the learned Government Pleader was directed to get instructions and the matter was ordered to be listed on 04.06.2019.

On 04.06.2019, when this writ petition came up for consideration, the learned Government Pleader submitted that the statement of the respondent shall be placed on

record within a week.

Heard the learned counsel for the petitioner and also the learned Government Pleader appearing for the

respondent.

The learned Government Pleader, on instructions, would submit that Ext.P3 request made by the petitioner for settlement of timings of the regular permit granted vide Ext.P1 shall be placed in the next timing conference to be convened by the respondent, who is the Secretary of the Regional Transport Authority.

In such circumstances, this writ petition is disposed of by directing the respondent to consider Ext.P3 request made by the petitioner for settlement of timings in the next timing conference, with notice to the petitioner and other enroute operators and take an appropriate decision, as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a certified copy of this judgment.
