the 1st respondent caused a representation to the 2nd respondent requesting to withhold payment of the performance guarantee and security deposit due to the appellant. It is further stated that, the 1st respondent had also caused a lawyer notice to the 2nd respondent demanding such withholding of payments. In the writ petition it was revealed that, the 1st respondent had filed a suit against the appellant and the 2nd respondent before the Munsiff Court, Aluva as O.S. No.80 of 2019, seeking injunction against the 2nd respondent from making payment of the security deposit and performance guarantee due to the appellant. But that suit was dismissed as not pressed, as evident from Ext.P4, allegedly on the basis that the appellant made promise to make payment of the amounts due. It is stated that, subsequently the 1st respondent filed another suit before the Sub Court, North Paravur, as O.S. No.56 of 2019, on 30.05.2019. That court had ordered urgent notice to the appellant and the case was posted to 07.06.2019. The writ petition was seen filed on 06-06-2019, seeking relief as mentioned above.
