Exts.B1 to B3 documents to show that the building was constructed by the grandmother of her husband and she had obtained the title over the building by virtue of Exts.B1 to B3 documents. Exts. B1 to B3 are ancient documents. On the other hand, the case advanced by the plaintiff is that the fourth defendant is only a building tenant. There is a clause in Ext.A1 sale deed, permitting the plaintiff to evict the fourth defendant from the building situated therein. A mere perusal of Exts.B1 to B3 would show that the building was constructed not by its owner, but by somebody else and it was given to the grandmother of the husband of the fourth defendant and she had obtained title and interest over the building structure by virtue of Exts.B1 to B3 documents. Infact the first appellate court entered into a finding that the building structure belongs to the fourth defendant and that the construction of permanent structure over the property would constitute an irrevocable licence under Section 60 of the Indian Easements Act, 1882. Before going into the above said question, going by Exts.B1 to B3, it is well clear that the building structure was not constructed by the owner of the property, who obtained the property under Ext.A2.
