Inspite of the injunction order, when interference was caused by the 2nd respondent and his henchmen, the petitioner herein approached this Court and filed W.P.(C) 22362 of 2004 seeking an order of police protection. Their Lordships of the Division Bench by Annexure-A2 order granted an order of police protection. The 2nd respondent herein was arrayed as the 8th respondent in the writ petition. Undeterred by the above orders, the 2nd respondent along with the defendants in O.S.No.406 of 1996, trespassed into the temple property violating the orders passed by the competent courts and committed mischief on 22.7.2004. On the same day itself, the 1st petitioner herein approached the police and lodged information based on which Crime No. 540 of 2004 was registered at the Karunagappally Police Station under Sections 188, 506(1), 447, 145, 147 r/w. Section 149 IPC. After investigation, final report was laid before the learned Magistrate and the case is pending as C.C.No.72 of 2005 on the files of the Judicial Magistrate of First Class, Karunagappally. Immediately thereafter, the 2nd respondent instituted a suit for injunction before the court of the Munsiff, Karunagappally on 24.7.2004 as O.S.No.367 of 2004 and secured an ex parte order of injunction. The said order was challenged by the 1st petitioner herein before this Court and by Annexure-A4 order, the order of injunction was stayed. The said suit was later transferred to the Munsiff Court, Sasthamcotta and the same was renumbered as O.S.No.48 of 2009 and the question of maintainability of the suit is pending consideration of the court below. According to the learned counsel, the sequence of events would show that no such incident as alleged had taken place on 26.7.2004 as alleged in the complaint.
