O R D E R

Petitioners are accused in Crime No.55/2019 of Kottarakara Police station for offences, punishable under section 324,427, 447,452,143, 147, 148,149 IPC.

Allegation of the prosecution is that, due to previous enmity, petitioners trespassed into the house of the defacto complainant on 7/1/2019 at 11.30 p.m , caused substantial damages to the household articles and to the vehicles parked therein. Damages were quantified at around Rs.1,00,000/-. Crime was registered. Apprehending arrest, petitioners seek bail.

It emerges that, petitioners have committed extensive damages to the car, motor cycle and other items. No serious personal injuries are seen inflicted by them. Hence, I am inclined to grant bail to the petitioners subject to the following conditions:

(i).Petitioners shall appear before the investigating officer within ten days from today and shall undergo interrogation. Thereafter, if they are proposed to be arrested, they shall be released on bail on each of the petitioner executing a bond for a sum of Rs.40,000/-(Rupees forty thousand only) with two sureties for the like sum each.

ii). They shall surrender their passport within one week from the execution of

the bond and if they are not in possession of the passport, file affidavit to that

effect.

iii). They shall deposit a sum of Rs. 15,000/- (Rupees fifteen thousand only) before the jurisdictional court within 15 working days from the date of execution of bond.

iv). They shall appear before the Investigating officer on all Fridays and Tuesdays between 9.00 a.m. and 10.00 a.m. for a period of two months from the date of execution of the bond.

(v). They shall not threaten, coerce or intimidate the defacto complainant and witnesses.

¶42

vi). They shall not get involved in any other offence.

¶43

Anticipatory Bail Application is allowed.
