This application is filed under Section 439 of the Cr.P.C.

The applicant herein is the 3^rd accused in Crime No. 1000 of

2019 of the Thrissur Town Police Station, registered under Section 420 r/w Section 34 of the IPC.

According to the prosecution, the accused Nos. 1 & 2 in the aforesaid crime acted as commission agents and induced the de facto complainant to part with a sum of Rs.1.4 lakhs towards value of agricultural products. The accusation against the applicant is that he actively aided the accused Nos.1 & 2. The applicant was arrested on 04.09.2019 and he remains in custody.

Heard the learned counsel appearing for the applicant as well as the learned Public Prosecutor.

The case records made available show that the investigation has made much headway. Having regard to the nature and gravity of the allegations, the role assigned to the applicant, period of incarceration undergone and the stage of investigation, his further detention does not appear to be necessitous. The applicant can be granted bail by imposing appropriate conditions.

In the result, this application will stand allowed. However, it shall

be subject to the following conditions:

(a) The applicant shall be released on bail on his executing a bond for Rs.50,000/-(Rupees Fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the court having jurisdiction.

(b) He shall appear before the Investigating Officer on all Saturdays between 10 a.m. and 1 p.m., for a period of two months or till the final report is laid, whichever is earlier.

(d) He shall not commit any offence while he is on bail.

¶31

In case of violation of any of the above conditions, the jurisdictional Court shall be empowered to consider the application for cancellation, if any, and pass appropriate orders in accordance with the law.
