The petitioner is the accused in Crime No.337 of 2019 of Malayinkeezhu Police Station registered for the offences punishable under Sections 294(b), 341, 323, 326 and 307 IPC.

The petitioner was arrested on 13.6.2019 and ever since he has been in custody.

Heard.

¶24

The learned Public Prosecutor has submitted that the petitioner is not involved in any other offence of similar nature. It appears that the major part of the investigation is almost complete. Considering the facts and circumstances of the case, including the stage of investigation and also taking into consideration of the fact that the petitioner is a first time offender, I am inclined to allow this bail application.

In the result, this application stands allowed and the petitioner shall be enlarged on bail on condition of the petitioner executing a bond for Rs.35,000/- (Rupees thirty five thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Jurisdictional Magistrate and subject to the following conditions:

(i) The petitioner shall report before the Investigating Officer on every Monday between 9 a.m. and 11 a.m. for three months and thereafter, as and when required by the Investigating Officer for interrogation.

(ii) The petitioner shall not get involved in any other offence of similar nature during the pendency of this case.

(iii) The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.
