The petitioner is the accused in Crime No.373/2019 of Wadakkancherry Police Station, registered for the offences punishable under Sections 406, 468 and 469 IPC.

The prosecution allegation is that the petitioner,

while working as the Head Mistress of an aided LP School, Veerolipadam, forged bills and receipts in respect of purchase

¶27

of milk, egg and rice and caused a loss to the tune of Rupees Six Lakh to the school during the period from 01.01.2015 to 31.12.2018.

The petitioner has filed this application under

Section 438 Cr.P.C.

The learned Public Prosecutor has submitted that

the petitioner has no criminal antecedent. It has been further

submitted by the learned Public Prosecutor that all documents relating to the transactions involved in this case were already seized by the police. Having gone through the relevant inputs, it appears that no recovery is to be effected from the petitioner. In the said circumstances, the custodial interrogation of the petitioner is not necessary for the progress of investigation of the case. The petitioner is a lady aged 49 years. The petitioner is under suspension at present. That apart, the petitioner has no criminal antecedent. In view of the above reasons, I am inclined to grant bail to the petitioner.

In the result, this application stands allowed and respondent Nos. 1 and 2 are directed to release the petitioner on bail in the event of her arrest in the above said Crime, on condition of the petitioner executing a bond for Rs.35,000/(Rupees Thirty Five Thousand only) with two solvent

sureties, each for the like sum to the satisfaction of the second respondent, before whom the petitioner shall surrender within ten days, if not arrested in the meantime and subject to the following further conditions:-

The petitioner shall report before the Investigating Officer on every Saturday between 9.00 a.m. and 11.00 a.m. for three months and thereafter, as and when required by the Investigating Officer for interrogation.

The petitioner shall not intimidate or influence the witnesses or in any way tamper with the investigation.

¶42

The petitioner shall co-operate with the investigation.
