The petitioner is the accused in Crime No.496 of

2019 of Kannur Town Police Station, registered for the offences punishable under Sections 454 and 381 IPC.

The petitioner was arrest on 17.04.2019 and

ever since he has been in custody.

Heard.

¶22

The learned Public Prosecutor has submitted

that the petitioner is not involved in any other offence of similar nature. It has been further submitted by the learned Public Prosecutor that the final report has been already filed, after completing the investigation. Considering the facts and circumstances of the case,

including the fact that the petitioner is the first time

offender and also the fact that the final report has been

already filed, I am of the view that the further detention of the petitioner is not necessary in this case.

In the result, this application stands allowed and the petitioner shall be enlarged on bail on condition of the petitioner executing a bond for Rs.35,000/(Rupees Thirty Five Thousand only) with two solvent sureties, each for the like sum to the satisfaction of the

Jurisdictional Magistrate and subject to the following further conditions:

(i) The petitioner shall not intimidate or influence the witnesses, who are likely to give evidence before the court.
