The applicants seeking anticipatory bail in Crime No.1981 of 2018 of Karamana Police Station, under Sections 342, 384, 452 and 506 r/w Section 34 of IPC, are A1 and A2 in the crime.

The prosecution case is that on 01.12.2018 at 12.00 p.m., the applicants trespassed into the flat where the de-facto complainant and her associate were employed and snatched away her mobile phone and a few imitation ornaments after wrongfully restraining them. It is stated that the phone and imitation ornaments were taken away after putting them in fear of death.

Notice was given to the learned Public Prosecutor and CD was perused. The CD discloses that the mobile phone was already recovered. Therefore, custodial interrogation of the petitioners may not be quite naturally required. In the circumstances, I am inclined to grant anticipatory bail.

The applicants shall appear before the investigating officer within ten days from today for being interrogated with respect to the matters relating to investigation of the aforesaid crime, and if the investigating officer proposes to arrest them, they shall be released on bail up on executing a bond for ` 50,000/- with two solvent sureties each for the like sum subject to his satisfaction and observance of the

following conditions.

(i) They shall thereafter appear before the investigating officer on every sunday between 10 a.m and 11 a.m, until final report is submitted before the jurisdictional magistrate.

(ii) They shall not interfere with the investigation in any manner

by intimidating or influencing the de-facto complainant or the witnesses.

¶26

(iii) They shall not involve in similar offences of theft or criminal trespass while being on bail.

In the event of breach of any of the above conditions, the concerned police officer shall bring the same to the notice of the jurisdictional court where the matter is pending, seeking to cancel the bail and thereupon the court concerned shall be at liberty to exercise the power of cancellation of bail in accordance with law.
