No.688/2018 of Kalloorkkad Police Station registered for the offences punishable under Sections 143, 147, 294(b), 323, 341, 353, 447 and 506(1) read with Section 149 IPC.

The petitioner has filed this application under

The learned Public Prosecutor has submitted

that the petitioner is not involved in any other offence of similar nature. Accused Nos. 1 to 4 were granted the relief under Section 438 Cr.P.C. by this Court as per order in B.A.No.8418/2018. The names of accused Nos 1 to 4

were figured in the FIR. The name of the petitioner was not figured in the FIR. Altogether, fifty persons took part in the demonstration. Since accused Nos. 1 to 4 were granted the relief under Section 438 Cr.P.C., I am inclined to grant the same relief to the petitioner as well, particularly when the name of the petitioner was not figured in the FIR. That apart, there is no criminal antecedent against the petitioner.

In the result, this application stands allowed and the respondent is directed to release the petitioner on bail in the event of his arrest in connection with Crime No. 688/2018 of Kalloorkkad police station, on condition of the petitioner executing a bond for Rs.40,000/- (Rupees forty thousand only), with two solvent sureties, each for the like sum to the satisfaction of the Station House Officer of Kalloorkkad Police Station, before whom the petitioner shall surrender within ten days, if not arrested in the meantime and

subject to the following further conditions:-

(i) The petitioner shall report before the Investigating Officer as and when required by the Investigating Officer for interrogation.
