The petitioners, who are holding Ext.P1 series
of contract carriage permits to ply their autorickshaws in all fit roads in Ernakulam District, subject to the condition that the vehicle shall not park or pick up passengers from within the city, with the respective parking places allotted in their permits, have filed this writ petition under Article 226 of the Constitution of India, seeking a writ of mandamus commanding the 1st respondent to receive and consider Exts.P2(a) to P2(c) applications. The petitioners have also
sought for a writ of mandamus commanding respondents 1 and 2 to vary the permit conditions so as to enable them to park their autorickshaws and pick up passengers from any stand, within the
limits of the 3rd respondent Municipality.

“The above Writ Petition (C), seeking variations in the permit condition so as to enable the petitioners to park their autorickshaws in the stand specified in the applications within the limits of 3rd respondent. When the matter came up for admission this honourable court pointed out that petitioners have not filed a proper application before the 1st respondent. Hence this honourable court may be pleased to permit the petitioner to withdraw the above writ petition with liberty to file a fresh writ petition after submitting proper application.”
