given higher pay scales than the government employees in corresponding posts. When revision was ordered in 1997 and 2004, they were allowed their higher scale of pay as their personal scale and could enjoy the corresponding revised scale. Pointing out that the employees under the 3rd respondent were getting higher scale of pay than their counter parts under government service, the Government, as per Ext.R1(a) letter again reminded the 2nd respondent, who was already directed to forward the proposal for modification of the service rules of the Council bringing it under direct control of Government, the powers of post creation, upgradation, redesignation, fixation of service conditions etc. for unification of scale of pay of identical posts in different R&D Centres and Head Quarters, for the consideration of the committee to be constituted by Government for the purpose and the protection of personal scale may be considered after the service rules and other relevant rules and regulations of the council is got approved by the Government. Government had found that the scale of pay of various posts under the 3rd respondent and various institutions under the 2nd respondent were more than that of the pay of Government employees in corresponding posts.
