JUDGMENT

The petitioner, who owns a building, received the Ext.P2 notice under the Kerala Revenue Recovery Act. It proposes to recover from the petitioner the amounts allegedly due under the Kerala Building and Other Construction Workers' Cess. In this Writ Petition the petitioner contends that he has never received the assessment notice.

Pending this Writ Petition, the petitioner applied under the Right to Information Act and secured the assessment order and also filed a statutory appeal on 23.11.2018, as is evident from the Ext.P4.

Now both the petitioner's counsel and the Government Pleader agree that the Court may close the Writ Petition, leaving it open for the petitioner to pursue his appellate remedy.

I, accordingly, close the Writ Petition. The authority may consider the appeal at the earliest. Until the respondent authority takes up the matter for hearing, the revenue will defer coercive steps.
