to get the benefit of revised scale of pay corresponding to that, which he was enjoying under the 8th pay revision. Ext.P3 Government order dated 2.8.1999, referred to in Rule 4, was issued on the basis of the recommendation of a committee which was constituted to examine the anomalies in the pay structure of employees under the 2nd respondent. In clause 5 of Ext.P3 it is provided that all the employees who were recruited or promoted or who have occupied the post of non-scientific (Technical) post after 6.12.1987 (after the issuance of G.O.Ms.30/87/STED dt.6.12.87) will be eligible only for State Government scales of pay and they will be considered as Administrative staff. But the qualification prescribed for promotion for non-scientific (Technical) posts recommended by the Committee is accepted even if they are considered as administrative staff. On the basis of the report of Committee which examined the anomalies in the institutions including the 2nd respondent, Government accepted the recommendation and ordered that the scale of pay for entry level and for assessment for existing staff would be as provided therein. This included scale of pay, qualification, method of appointment, promotion chances, etc. of all non scientific staff (Administrative) of all the R & D centres as indicated in Annexure 2. The scale of pay of Gardeners is given under Sl.No.34/45. Gardener of the 2nd respondent was fixed as Rs.550-800, revised as Rs.750-1025 and Head Gardener's pay is Rs.575-900 and revised as Rs.775-1160. Petitioner was enjoying the corresponding revised pay scale. While issuing the pay revision order Ext.P12 and Government order Ext.P14, Rule 4 of Ext.P1 is given a go-by in the case of Gardeners like the petitioner. At the same
