from the existing former use of the land, lay out of streets and footpaths, sub-division of land for residential plots or for other uses including lay out of internal streets etc.,etc. Therefore, according to the municipality since there is no development permit secured by the owner of the property, who has subdivided the entire property and sold to the petitioner a portion, the petitioner is not entitled to get the building permit concerned. However, in my considered opinion the municipality can regularise the issue with respect to the development permit also by receiving suitable application from the petitioner. In that view of the matter I think it is only appropriate that, the petitioner is given the opportunity to submit a suitable application before the municipality for appropriate action. If the petitioner makes any application within two weeks from the date of receipt of a copy of this judgment before the second respondent, it shall be considered by the second respondent within a month from the date of receipt of the application, in accordance with law.
