dispute that on the date on which the Rent Control Petition was filed, viz., 04-03-2014, the shop room was not open. The tenant was running a business in the tenanted premises under the name and style “Vishnu Cottons”. At the time when the Advocate Commissioner inspected the tenanted premises, the shutters were found locked. The Commissioner had also noticed the fact that the verandah of the shop room was being used by the homeless. The explanation offered by the tenant was that as she had gone abroad to be with her ailing husband, her mother was running the business on her behalf, but due to her illness she could not open the shop and run the business during the period from 03-03-2014 to 07-03-2014 and that it was during the said period that the Advocate Commissioner inspected the shop room. The petitioner did not for reasons best known to her produce bill books or account books maintained by her to prove that even during her absence from India for more than six months, which is an admitted fact, her mother was transacting business on her behalf.
