memorandum of agreement filed before this court, which contains the terms of the settlement. By virtue of the settlement, it is evident that the respondent had agreed for the custody of the child with the petitioner, subject to visitorial rights reserved in his favour. It was also recorded that, Passport of the minor child was handed over to the respondent. Now the petitioner had filed OP No.511/2018 before the Family Court seeking modification of the settlement with respect to custody of the minor child. She is seeking a declaration to the effect that she is entitled to have absolute custody of the minor child. It is stated that, the respondent had already entered appearance in the said original petition before the Family Court and the case now stands posted to 30-06-2018. In the meanwhile, the petitioner filed IA No.931/2018 before the Family Court, seeking direction to the respondent to hand over Passport of the minor girl. According to the petitioner, she is intending to take the minor girl abroad, where the petitioner is living at present.
