Ext.P5 order passed by the Land Tribunal, Kasaragod on I.A.No.74 of 2017 in S.M. 2038 of 1975 is under challenge in this original petition. Land comprised in resurvey No.748/Part in Munnad Village, measuring an extent of 50 cents, was originally assigned to the petitioner's father Krishnan. The assignment was effected as per order in S.M.2038 of 1975 and Ext.P2 purchase certificate bearing No.2420 of 1977 was issued in his favour. Said Krishnan expired about 15 years back. Thereafter the property devolved on his legal heirs including the petitioner. The contention raised by the petitioner before the Land Tribunal was that the survey number shown in the purchase certificate was wrong. Instead of showing resurvey No.748/Part, in the purchase certificate it is shown as resurvey No.708. When the mistake was noticed, petitioner approached the Village Officer, Munnad and took steps to correct it. An application was filed before the Land Tribunal for getting the survey number corrected. Ext.P4 is report dated 13.11.2017 submitted by the Village Officer, Munnad, before the Tahsildar (LR), Kasaragod, stating that there is a mistake crept in the survey number in the purchase certificate issued in the name of Krishnan. Still, the application filed by the petitioner was dismissed by the Land Tribunal as per Ext.P5 order.
