The petitioner herein is the sole accused in S.C 640/2016 of the Court of Session, Kasaragod. The case is now pending before the learned II Additional Sessions Judge, Kasaragod. On the apprehension of arrest and remand to judicial custody in view of the warrant of arrest issued from the court below, the petitioner seeks orders directing the trial court to consider his application for bail on the date of filing itself. Of course, direction as regards bail cannot be passed by this Court in this proceeding. In view of the warrant of arrest from the trial court, the accused will have to surrender there and make application for regular bail. Let him explain his absence throughout, and let appropriate decision be taken by the learned trial Judge. However, the request for direction can be considered. Accordingly, this Crl.M.C is disposed of, with direction to the court below that in case application for bail is filed by the petitioner on surrender in S.C 640/2016, or on production by the Police on arrest in execution of
