Petitioner is the accused in C.C. No.95 of 2018 on the file of

the Judicial Magistrate of First Class-I, Thiruvananthapuram registered for the offences under Sections 279 and 304A IPC. His prayer is to permit him to go abroad in connection with his job.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The case is pending before the court in which there is huge pendency of cases. There is no likelihood of the case being taken up in the near future. So I am inclined to grant the prayer of the petitioner. In the result, this Crl.M.C is allowed subject to conditions.

(I) The petitioner is permitted to go abroad for a period of one year.

¶35

(ii) He shall file an undertaking in the form of an affidavit that within 10 days of his return to India he will surrender his passport.

¶36

(iii) He shall deposit in the trial court a sum of Rs.25,000/- (Rupees Twenty five thousand only) which will stand forfeited if he fails to comply with any of the conditions in this order or the bail order.

(iv) He shall furnish his foreign address and contact numbers.

¶38

(v) He shall produce four self addressed stamped envelopes so that process can be issued to him from the court at his foreign address.
