In Ext.P6 lawyer notice and in the complaint and also in the evidence of PW1 in his examination-in-chief, the contention of the appellant was that the accused issued Ext.P2 cheque dated 14.01.2002 towards the discharge of the liability to the appellant in connection with the borrowing of an amount by the accused from the appellant. However, the date of borrowing the money and the date when the cheque was issued, were silent in Ext.P6 notice and in the complaint and also in the evidence of PW1 in his examination-in-chief. However, in the cross-examination, PW1 stated that the amount was given on 14.01.2002. PW1 did not disclose anything with regard to the business transaction between PW1 and the accused, till PW1 was confronted with Ext.D1 series.
