Petitioners are accused Nos. 20 & 21 in Crime No.253/2018 of Pampa Police Station for offences punishable under Sections 143, 147, 353, 341 read with Section 149 IPC. The allegation of the prosecution is that the petitioners formed into

an unlawful assembly and interfered in the discharge of the official duties of Police. It is stated that they attempted to obstruct the devotees. Crime was registered and the petitioners apprehending arrest, seek bail.

2. It is reported that out of the 100

¶34

accused, 19 accused have been arrested and some

¶35

were released. Petitioners seem to have not committed any activity causing damage to the public property. They are not seen involved in any other crime. Having considered these facts, I am inclined to grant the benefit of pre-arrest bail to the petitioners.

Hence, the anticipatory bail applications are allowed on the following conditions:

(i) Petitioners shall appear before the Investigating Officer within 10 days from today and shall undergo interrogation. Thereafter, if they are proposed to be arrested, they shall be released on bail on each of the petitioner

executing a bond for a sum of 40,000/- (Rupees₹ forty thousand only) with two sureties for the like sum each.

(ii) They shall appear before the

Investigating Officer as and when called for and co-operate with the investigation.

¶43

(iii) Except for the compliance of the above conditions or for appearance in any court of law where their appearance is mandatory, they shall not enter the limits of Pampa Police Station for a period of three months. However, in case of extreme emergency, they may enter the limits with

the prior permission in writing of the jurisdictional court in this crime.

(iv) They shall not threaten, coerce or intimidate the defacto complainant or the witnesses.

(v) They shall not get involved in any other identical offence and the involvement if any, will be a ground for cancellation of bail.
