Petitioner is the sole accused in Crime No.1051/2018 of Ezhukon Police Station for offences punishable under Sections 324, 452, 354, 427 and 308 of IPC. It is alleged by the prosecution that on 03.07.2018 at about 9.00 p.m., accused trespassed into the property of the de facto complainant and assaulted the de facto complainant. It is stated that he committed mischief also. Pursuant to the complaint laid, crime was registered and the investigation is progressing.

2. It seems that the parties are neighbours and they were not maintaining good relationship. According to the petitioner, an earlier complaint was laid by the mother of the petitioner against the husband of the de facto complainant as C.C.No.249/2009 and the husband of the de facto complainant was convicted. To retaliate it, the present complaint was filed, it was contended.

3. Evidently, the allegation against the petitioner does not appear to be very serious. Essentially it is to be proved by the oral evidence. Hence, I do not feel that a custodial interrogation of the petitioner is essential.

Hence, I am inclined to grant the benefit of prearrest bail to the petitioner.

Accordingly, the anticipatory bail

application is allowed on the following

conditions:

(i) Petitioner shall appear before the Investigating Officer within 10 days from today and shall undergo interrogation. Thereafter, if

he is proposed to be arrested, he shall be released on bail on he executing a bond for a sum of 40,000/- (Rupees forty thousand only) with two₹ sureties for the like sum each.

(ii) He shall not threaten, coerce or intimidate the defacto complainant or the

witnesses.

(iii) He shall appear before the Investigating Officer as and when called for and co-operate with the investigation.

(iv) He shall not get involved in any other identical offence and the involvement if any, will be a ground for cancellation of bail.
