This is an application for regular bail filed under

Section 439 of the Code of Criminal Procedure.

The petitioner is the sole accused in Crime No.8 of 2018 of Bandadka Excise Range, Kasaragod registered for the offence punishable under Section 55(g) of the Abkari Act.

The prosecution allegation is as follows:

On 7.3.2018 at about 5.30 p.m, the petitioner was

found in possession of 20 litres of wash kept for distillation in contravention of the provisions of the Abkari Act and thereby commited the aforesaid offence.

The petitioner has been in custody since 4.3.2018.

Heard the learned counsel for the petitioner as well

as the learned Public Prosecutor.

It is submitted by the learned counsel for the petitioner that she is a lady aged 60 years and she is totally innocent of the allegations levelled against her. The learned Public Prosecutor has opposed the application contending that she was an accused in another crime registered in the year

2014 as Crime No.25 of the very same Excise Range.

Considering the period of detention undergone by her

as well as the fact that the investigation is almost completed, I am inclined to release her on bail subject to following conditions

The petitioner shall be released on bail on her executing a bond for Rs.50,000/- (Rupees fifty Thousand only) with two solvent sureties each for the like sum to the satisfaction of the court below.

She shall appear before the Investigating Officer for interrogation as and when directed.

¶37

She shall not intimidate or attempt to influence the witnesses, nor shall she tamper with the evidence.

She shall not commit any offence while she is on

bail.

In case of violation of any of the above conditions,

the learned Magistrate concerned is empowered to cancel the bail in accordance with law.
