The petitioner herein apprehending arrest in Crime No.150/2017 of kanakakunnu Police Station, Alappuzha District for offences punishable under sections 143, 147, 148, 149, 294(b), 506, 341, 452 and 427 of the Indian Penal Code, seeks bail.

The crux of the allegation against him was that on 9.12.2017, at 6.00 p.m., the petitioner herein along with others formed into an unlawful assembly and trespassed into the office of the political party and ransacked the office. It is also alleged that they wrongfully confined a person. Loss caused is quantified at about Rs.2000/-.

Opposing the application the learned Public Prosecutor submitted that the petitioner herein is involved in yet another case under the KP Act. In relation to the incidents that had happened above, other crimes were also registered.

Having considered the nature of allegations, I

feel that bail can be granted to the petitioner herein on the following conditions:

(i) Petitioner shall appear before the

investigation officer within ten days from today and shall undergo interrogation. Thereafter, if he is proposed to be arrested, he shall be released on bail on executing a bond for a sum of Rs.30,000/- (Rupees thirty thousand only) with two sureties for the like sum each.

(ii) He shall appear before the investigating

¶29

officer as and when called for.

¶30

(iii) He shall not threaten, coerce or intimidate the defacto complainant or the witnesses.

(iv) He shall not get involved in any other identical offence.

¶32

Anticipatory bail application is allowed as above.
