The petitioner is the first accused in Crime No.2 of

2017 of Vigilance and Anti Corruption Bureau, Kannur registered for the offences under Sections 13(1)(d) read with 13(2) of the Prevention of Corruption Act and Section 120B IPC.

The petitioner has filed this application praying for

the relief under Section 438 Cr.P.C.

The learned special Public Prosecutor has submitted that the arrest of the petitioner is not necessary

for the progress of the case and hence, the learned special Public Prosecutor has no objection in allowing this application. Considering the facts and circumstances of the case, including the submission of the learned special Public Prosecutor, I am inclined to allow this application.

In the result, this application stands allowed and the first respondent is directed to release the petitioner on bail in the event of his arrest in Crime No.2 of 2017 of Vigilance and Anti Corruption Bureau, Kannur, on condition of the petitioner executing a bond for Rs.30,000/(Rupees thirty thousand only) with two solvent sureties, each for the like sum to the satisfaction of the Investigating Officer, before whom the petitioner shall surrender within
