JUDGMENT

The petitioner, who has retired from service of the 1^st respondent University on 21.11.2012, seeks direction to the respondents to release pensionary benefits due to him. It is submitted that on the ground that a vigilance enquiry had been conducted as against him as well, the entire pensionary benefits are being withheld. It is submitted by learned counsel for the petitioner that a preliminary report has been submitted absolving the petitioner and that no vigilance case has been registered against him. In the above circumstances, the petitioner has submitted Exhibit P4 representation dated 19.11.2016 before the University seeking disbursal of his pensionary benefits.

Heard learned counsel for the petitioner and the learned counsel appearing for the University.

In the facts and circumstances of the instant case, I am

of the opinion that the University has to take a decision on Exhibit P4 representation, since the issue involves pensionary

benefits due to a person who has retired as early as in November, 2012. This writ petition is, therefore, disposed of directing the 1^st respondent to consider and pass orders on Exhibit P4 representation within a period of one month from the
