J U D G M E N T

The petitioner, who is working as Senior Accountant at Azhikode Branch of the 1^st respondent Co-operative Bank, has approached this Court in this writ petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus commanding respondents 1 and 2 to re-submit the application for grant of relaxation of his educational qualification for promotion as Branch Manager, to the 4^th respondent, through the 3^rd respondent, with a further direction to the 4^th respondent to take an appropriate decision thereon.

On 23.11.2017, when this writ petition came up for admission, the learned Standing Counsel for the 1^st respondent Bank sought time to get instructions.

Heard the learned counsel for the petitioner, the learned Standing Counsel appearing for respondents 1 and 2 and also the learned Senior Government Pleader appearing for respondents 3 and 4.

The learned Standing Counsel for the 1^st respondent Bank on instructions would submit that the application referred to hereinbefore has already been re-submitted to the 3^rd respondent on 03.03.2017 for transmission to the 4^th respondent.

The learned Senior Government Pleader would submit that, if the application has already been re-submitted to the 4^th respondent, through the 3^rd respondent, the 4^th respondent shall pass appropriate orders thereon, with notice to the petitioner and also to the 1^st respondent Bank, within the time limit to be fixed by this Court.

In such circumstances, this writ petition is disposed of directing the 4^th respondent to consider and pass appropriate orders on the request made by the 1^st respondent Bank regarding relaxation of educational qualification of the petitioner for being promoted as Branch Manager in the District Co-operative Bank, Kannur, as expeditiously as possible, at any rate, within a period of one month from the date of production of a certified copy of this judgment, with notice to the petitioner and also to the 1^st respondent Bank.

It is made clear that this Court has not expressed anything on the merits of the claim made by the petitioner and it is for the 4^th respondent to take an appropriate decision, strictly in accordance with law.
