JUDGMENT

1.The prayers in this writ petition are as follows:-

“(i)Call for the records relating to Exhibit P12 from the 3^rd respondent herein and quash all proceedings and the order passed by the 3^rd respondent vide Exhibit P-12 by the issue of a writ of certiorari or any other writ or order.

(ii)Issue a writ of mandamus or any other appropriate writ, order or direction, directing the 3^rd and 4^th respondent to adhere to the directions in Exhibit P1 to P5 in the matter of allowing Students Travel Concessions while issuing the Students Travel Concession Cards.”

Heard the learned counsel for the petitioner, the learned Senior Government Pleader appearing for respondents 1 to 4 and the learned standing counsel for the 5^th respondent.

It is submitted by the learned counsel for the petitioner that the Government Orders specifically prescribed the mode of grant of travel concession passes to students and only those

passes which have been countersigned by the RTO and Joint RTO can be used by the students to avail students travel concession. The directions contained in the impugned orders are to the effect that the students of the 5^th respondent institution are entitled to a preferential treatment inasmuch as students identity cards issued by the Prinicpal can be produced by them for availing travel concession cannot be countenanced, in view of the specific Government Orders on the subject.

4.After hearing the contentions advanced, I am of the opinion that the Government Orders regarding the travel concession which are produced by the petitioners as Exts.P1 to P4 being still in force, it is not open to the respondents to contend that the identity cards issued by the Principal of the Self financing college can be used to avail travel concession.

The learned counsel for the petitioner contends that Ext.P10 order has since been recalled by the 4^th respondent by a communication dated 12.08.2016 wherein it has been stated

that only identity cards/passes issued by the RTO or the Joint RTO can be used by the students who avail the travel concession.

In the above view of the matter, this writ petition is disposed of directing that the students of the 5^th respondent institution will be entitled to travel concession only on production of passes as provided in Exts.P1 to P5.

This writ petition is ordered accordingly.
