The argument advanced by learned counsel for the petitioner on the strength of the decisions referred to above is to the effect that the effect of the acquittal by the criminal court on charges arising from the same set of facts has to be considered by the competent authority in the organisation of the employer to consider whether the punishment awarded was necessary in the light of the findings of the criminal court. It is submitted that the petitioner having attained the age of superannuation, a case of reinstatement would not arise and the only question which remains now would be as to his eligibility for pensionary benefits.
