The grievance of the petitioner in the above writ petition was inclusion of questions, out of syllabus, in the examination for the 1^st year Master of Dental Surgery (MDS) conducted in November 2011. It was submitted, even at that point of time, that the Expert, appointed by the University, has specifically reported that no out of syllabus questions have been included in the question paper.

There is a certificate dated 24.02.2012, produced as Ext.R1A, which states that MDS students cannot raise a contention of an out of syllabus question being included merely for the reason that it relates to the BDS curriculum, which, in any event, a Post Graduate student is expected to know. It is also

reported that the question comes under the topic “Post natal growth and development of bony and soft tissue structure of the head and neck”

In such circumstance, nothing survives in the writ petition and the writ petition is dismissed. No Costs.
