JUDGMENT

P.N. RAVINDRAN, J.

This appeal arises from the judgment delivered by the learned single Judge on 27.5.2013 in W.P.(C).No.29671 of 2012. The appellant is the fifth respondent therein. The above appeal was presented in this court on 17.10.2013 along with C.M.Appln.No.911 of 2013 to condone the delay of 96 days in filing the appeal.

When the application to condone delay came up for consideration today, Sri. Jithin Babu, learned counsel representing Sri. G. Sreekumar (Chelur), learned counsel appearing for the appellant submitted that the appellant is not desirous of prosecuting this appeal any further and therefore the appeal and the accompanying application to condone the delay in filing the appeal may be dismissed as withdrawn.

In the light of the said submission, C.M.Appln.No.911 of 2013 to condone the delay of 96 days in filing W.A. No. 1631 of 2013 and W.A.No.1631 of 2013 are dismissed as withdrawn.
