This appeal by the plaintiffs arises from the decree and judgment passed by the Court of the Subordinate Judge of Palakkad on 15.7.2011 in O.S.No.434 of 2007. By the impugned judgment, the suit instituted by the appellants for partition of the plaint schedule properties was dismissed. Learned counsel appearing for the appellants has now filed a memo dated 20.10.2017 to the effect that the appellants are not desirous of prosecuting the instant appeal and therefore, it may be dismissed as not pressed. In the light of the said memo, a copy of which shall be appended to this judgment, the instant appeal is dismissed as not pressed. Registry to communicate a copy of this judgment to the court below.
