permit the plaintiff to construct a compound wall through the eastern boundary line. Such a prayer cannot be granted simply because of the reason that if a compound wall is constructed through the boundary line, the width of compound wall would partially abut into both the sides of boundary line. In other words, when a compound wall is constructed, the boundary line would pass through the middle of the compound wall. That cannot be granted as the decree granted is against trespass of any portion of the property owned by the plaintiff. At the same time it is permissible to permit the plaintiff to construct a compound wall within their boundary and adjoining to the boundary. Going by Exts.C1 and C2, there is considerable doubt as to the location of northern portion of the compound wall situated in the eastern boundary. The southern portion of the eastern wall is perfectly situated within the property of the plaintiff. In the said circumstances, it is always fit and proper to permit the plaintiff to construct a compound wall within his property and adjoining to the boundary line, for which a commission can be deputed. With the help of a surveyor the property made mention of in Exts.C1 and C2 can be located.
