the Mediation Centre attached to this Court, now it is stated by the learned counsel appearing for the respondent/accused that the accused has instructed to submit that he is not in a position to comply with the terms and conditions of the mediation agreement and that the matter may be decided on merits. In view of the submission, learned counsel appearing for the petitioner/complainant has argued on the merits of the matter. It is pointed out that the complaint was initially filed before the Judicial First Class Magistrate Court-III, Kozhikode, wherein later the case was transferred to the court of the Additional Chief Judicial Magistrate (Economic Offences), Ernakulam, and the complaint was presented on 17.10.2014 along with an application to condone the delay of 12 days in filing the complaint. The delay application was numbered as Crl.M.P.No.3064 of 2014 and the respondent/accused had appeared and the delay was condoned. Thereafter, the case was transferred to the court of the Additional Chief Judicial Magistrate, Ernakulam, by order dated 3.3.2015 and the complainant was informed that notice shall be served to the complainant regarding the next hearing date and after a longtime, it was known that the case was again be transferred to the Judicial First Class Magistrate Court (N.I.Act Cases), Kochi, and the complainant had received a notice from that court for
