The petitioner is the accused for the offence under Sec.138 of the Negotiable Instruments Act, in C.C.No.53/2011 on the file of the Judicial First Class Magistrate Court-I, Kozhikode, instituted on the basis of a complaint filed by R-2 herein. The trial court as per the impugned judgment rendered on 18.2.2013, had convicted the petitioner for the above said offence and sentenced him to undergo simple imprisonment for a period of three months and to pay a sum of Rs.3.52 lakhs to be paid to the complainant as compensation under Sec.357(1) of the Cr.P.C., and in default thereof the accused was sentenced to undergo simple imprisonment for a further period of three months.
