The petitioner has been arrayed as accused No.1 in C.C.No. 761/2016 on the file of the Judicial First Class Magistrate's Court, Ramankary in Alappuzha district, on the basis of the complaint preferred by the 2nd respondent herein. Accused No.2 in the abovesaid complaint has already been enlarged on bail, it is averred. It is stated that the petitioner was not aware about the pendency of the abovesaid complaint earlier and that it is only recently, that he came to know that a non-bailable warrant has been issued by the Magistrate against him due to his non appearance and that the case has now been included in the long pending case list. That the petitioner is a law abiding citizen and is prepared to voluntarily surrender before the learned Magistrate and seek bail. That this Court may direct the learned Magistrate to consider his application for bail, recall of warrant, etc., on the same day on his surrender, as otherwise he may be remanded to judicial custody, in view of the non-bailable warrant issued against him, etc. The prayer in this Crl.M.C. is as follows:
