1.This application is filed under Section 439 of the Code of Criminal Procedure.

2.The applicants have been arrayed as accused Nos.1 to 3 in

Crime No. 1217 of 2017 of Puthoor Police Station. The said crime has been registered alleging offences punishable under Sections 452, 294(b), 324, 308, 326 read with Section 34 of the IPC. They seek their enlargement on bail .

3.The prosecution allegation is that on 31.7.2017 at 9.30 p.m., the applicants herein trespassed into the cattle farm of the de facto complainant and assaulted him with weapons causing injuries. They were arrested on 03.08.2017 and are now in judicial custody.

4.Heard the submissions advanced by the learned counsel

appearing for the appilcants and the learned public prosecutor. I have also perused the materials which were made available.

5.After having considered the nature and gravity of allegations, the period of incarceration undergone, the stage at which investigation has reached and other facts and circumstances, I am of the view that the applicants can now be released on bail.

6.In the result, this application wil stand allowed. However, it shall be subject to the following conditions which shall strictly be complied with.

Each of the applicants shall be released on bail on their executing a bond for Rs.50,000/(Rupees Fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the court having jurisdiction.

The applicants shall appear before the Investigating Officer on all Saturdays between 9 AM and 10 AM, for 2 months or till final report is filed, whichever is earlier.

The applicants shall not intimidate or

attempt to influence the witnesses; nor shall they tamper with the evidence.

The applicants shall not commit any offence while they are on bail.

The applicants shall not leave the country without the permission of the concerned Court.

In case of violation of any of the above conditions, the

jurisdictional court shall be at liberty to cancel the bail in accordance with the law.
