Petition filed under Section 438 Cr.P.C.

The petitioner is the 5^th accused in O.R.No.2 of 2017 of Karikulam Ranny Forest Range in Pathanamthitta district registered for the offences under Sections 2(16), 9, 39, 50 and 51 of the Wild Life Protection Act.

The prosecution case is that accused 1 to 4 were found to be in possession of two pairs of Slender Loris ('Kuttithevank'). When the forest officers approached them, the petitioner also was found along with them and he ran away. The investigation revealed that the petitioner was in possession of the wild animals for certain time.

Heard the learned counsel for the petitioner and the learned Public prosecutor.

It was revealed in the investigation that the second accused entrusted the wild animals to the petitioner and he happened to keep them. There is no other allegation against him. Having regard to the nature of the allegation I am inclined to grant his prayer.

In the result, this application is allowed.

The petitioner shall be released on bail after interrogation on his executing a bond for Rs.Twenty five thousand only with two solvent sureties each for the like sum if he is arrested by the Police in connection with this case.

1. He shall appear before the Investigating Officer for interrogation on 7^th

and 14^th days after his release.

1. He shall not get himself involved in any other criminal case while he is

on bail.

1. He shall not intimidate or attempt to influence the witnesses.

1. He shall not destroy or tamper with the evidence.

¶37

He shall surrender his passport before the lower court concerned or if he does not have one he shall file an affidavit to that effect within five days of his release.

If he surrenders before the Magistrate this order is not applicable and the learned Magistrate may pass appropriate orders.

In case of violation of any of the above conditions, the learned Magistrate is empowered to cancel the bail in accordance with the law.
