Petition filed under Section 438 Cr.P.C.

Petitioner is the eight accused in Crime No.335 of 2017 of Kayamkulam Police Station registered for the offences under Sections 143, 147, 148, 447, 323, 324, 452 and 326 r/w Section 34 of the Indian Penal Code. The allegation is that she along with the co-accused trespassed into the house of the victims and assaulted them with weapons causing them injuries. One of the victims sustained fracture of a bone.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

Some of the co-accused have already been granted anticipatory bail by this Court. The petitioner also is entitled to anticipatory bail.

In the result, this application is allowed.

i. The petitioner shall be released on bail after interrogation on her executing a bond for Rs.25,000/- (Rupees twenty five thousand only) with two solvent sureties each for the like sum if

she is arrested by the Investigating Officer in

connection with this case.

ii. She shall surrender her passport before the lower

court concerned or if she does not have one she shall file an affidavit to that effect within five days of her release.

iii. She shall not get herself involved in any other criminal case while she is on bail.

¶31

iv. She shall not intimidate or attempt to influence the

¶32

witnesses.

¶33

v. She shall not destroy or tamper with evidence.

¶34

In case of violation of any of the above conditions, the

¶35

learned Magistrate is empowered to cancel the bail in accordance

¶36

with the law.
