The petitioner is accused in Crime No.671/2016

¶22

of the Atholy Police Station registered for the offences under Section 10 of the Protection of Children from Sexual Offences Act. He is a teacher in a school. The victim is a 5^th standard student of his school. The allegation is that on several occasions he sexually harassed her.

The learned counsel submits that this is a politically motivated false case.

I have perused the case diary. The allegation

is that the incident happened in an open class. There are some suspicious circumstances in the case. So, I am inclined to grant the prayer of the petitioner for anticipatory bail.

In the result, the application is allowed.

The petitioner shall be released on bail after

interrogation on his executing a bond for Rs.25,000/- (Rupees

He shall surrender his passport before the

lower court concerned or if he does not have one he shall file an affidavit to that effect within five days of his release.

He shall not intimidate or attempt to influence

the witnesses.

He shall not destroy or tamper with evidence.

In case of violation of any of the above conditions,

the learned Magistrate is empowered to cancel the bail in accordance with the law.
