General has no authority to require the petitioner to undergo any medical examination. Exhibit P8 objection is, therefore, completely devoid of merit. The same is set aside. It is directed that the application for commutation of pension, which has been sanctioned by the High Court, shall be immediately taken up by the 2nd respondent and orders admitting the amounts due to the petitioner, taking the commutation factor at the State rate shall be issued within one month from the date of receipt of a copy of this judgment. The amount of commuted value of pension shall carry interest at the rate of 8% per annum from one month after the date of sanction of the amount, i.e., 4.8.2015 till the date of payment. It is further directed that the 1st respondent shall take up the claim of declaration of probation of the petitioner in the category of Additional District & Sessions Judge and pass orders thereon within three months. Since the order of retirement of the petitioner was declared by this Court to take effect only from 11.10.2011, the petitioner was entitled to be paid his salary from 1.11.2010 to 10.11.2011.
