The challenge in the writ petition is against Ext.P7 sale deed that was issued by the respondent bank in favour of the auction purchaser, in a sale conducted under the provisions of the Securitisation and Reconstructions of Financial Assets and Enforcement of Security Interest Act, 2002, hereinafter referred to as the 'SARFAESI Act'. Although various contentions are raised in the writ petition challenging Ext.P7 sale deed, I am of the view that if the petitioners are aggrieved by the sale deed conducted by the 1st respondent bank, in proceedings under the SARFAESI Act, then the remedy of the petitioners lies in approaching the Debts Recovery Tribunal [DRT] with an application for setting aside the sale and getting the matter adjudicated before the said Forum. Accordingly, without prejudice to the right of the petitioners, if any, to approach the DRT for setting aside Ext.P7 sale deed, the writ petition is dismissed as not maintainable.
