petition are seniors to respondents 4 and 5 who have been promoted to the post of Senior Superintendent and Junior Superintendent in terms of Exhibit P3 Special Rules. It is submitted that Exhibit P3 Special Rules contains a specific provision that rights or benefits of employees, who had been appointed in the erstwhile Public Health Engineering Department or Kerala Water Authority under the Kerala Public Health Engineering Subordinate Services Special Rules, shall be protected. It is submitted that the post of Senior Superintendent and Junior Superintendent in the Kerala Water Authority are posts under the ministerial wing of the authority and the rules applicable to the posts in question were Exhibit P2 rules, i.e., the Kerala Water and Waste Water Authority Administrative Ministerial and Last Grade Service Rules, 1986. Going by Exhibit P2 rules, the petitioners were fully qualified for appointment to the post of Senior Superintendent and Junior Superintendent respectively. It is further submitted that by Exhibit P10 order issued by the Government, Rule 12(1) of Exhibit P3 rules have been corrected by substituting the words Kerala Water and Waste Water Authority Administrative
